Understanding Bill C-3: Changes to Citizenship by Descent in Canada

On June 5, 2025, the Canadian government introduced Bill C-3, which amends the Citizenship Act to clarify and adjust the rules about citizenship by descent. These changes are especially important for immigrants and Canadian citizens with children born outside of Canada.

What is Citizenship by Descent?

Citizenship by descent means that a child born outside Canada can acquire Canadian citizenship if at least one parent is a Canadian citizen. However, under current rules, this is usually limited to the first generation born abroad. Specifically, a Canadian citizen parent can only pass their citizenship to their child born overseas if the parent was born or naturalized in Canada before the child's birth.

What Does Bill C-3 Change?

  • It reaffirms the first-generation limit on citizenship by descent, meaning children born abroad to Canadian parents who themselves were born abroad cannot automatically claim citizenship.
  • It provides a clear provision for adopted children born outside Canada. Canadian citizens who were born or naturalized in Canada before adopting a child abroad can now apply for a direct grant of citizenship for the adopted child.
