Please read these Terms of Service carefully before using the services provided by RSTM Immigration. By engaging our services or using our website, you agree to be bound by these terms and conditions.

1. About Our Services

RSTM Immigration is a licensed immigration consulting firm. Our consultants are Regulated Canadian Immigration Consultants (RCICs) registered with the College of Immigration and Citizenship Consultants (CICC).

Our services include, but are not limited to:

  • Immigration assessment and eligibility evaluation
  • Express Entry application assistance
  • Provincial Nominee Program (PNP) applications
  • Work permit and LMIA applications
  • Study permit applications
  • Family sponsorship applications
  • Visitor visa and Super Visa applications
  • Citizenship applications
  • Immigration appeals and humanitarian applications

2. Client Responsibilities

As our client, you agree to:

  • Provide Accurate Information: Furnish complete, accurate, and truthful information for all immigration applications. Misrepresentation can result in application refusal, bans, and legal consequences.
  • Timely Document Submission: Provide all requested documents within the specified timeframes to avoid delays in your application.
  • Maintain Communication: Respond promptly to our inquiries and keep us informed of any changes to your contact information or circumstances.
  • Review Documents: Carefully review all documents and applications before signing, as you are ultimately responsible for the accuracy of your submissions.
  • Pay Fees: Pay all agreed-upon professional fees and government filing fees in a timely manner.
  • Comply with Laws: Comply with all Canadian immigration laws and regulations throughout the process.

3. No Guarantee of Outcome

Important: No immigration consultant or lawyer can guarantee the approval of any immigration application.

The decision on all immigration applications rests solely with Immigration, Refugees and Citizenship Canada (IRCC) or other relevant government authorities. While we strive to prepare the strongest possible applications based on your circumstances, approval is never guaranteed.

Factors beyond our control that may affect application outcomes include:

  • Changes to immigration policies and regulations
  • IRCC processing times and priorities
  • Officer discretion in application assessment
  • Incomplete or inaccurate information provided by the client
  • Security, health, or admissibility concerns

4. Fees and Payment

Professional Fees: Our professional fees are outlined in the Retainer Agreement signed before the commencement of services. Fees vary based on the complexity and type of immigration service.

Government Fees: All government filing fees, biometric fees, and other official charges are separate from our professional fees and are payable directly or through us as specified.

Payment Terms:

  • Payment schedules are outlined in your Retainer Agreement
  • We accept credit cards, debit cards, and bank transfers
  • Late payments may result in service suspension or additional charges
  • All fees are quoted in Canadian dollars (CAD) unless otherwise specified

Third-Party Costs: Additional costs may include language testing fees, credential assessment fees, medical examination fees, and police clearance fees. These are your responsibility unless otherwise agreed.

5. Refund Policy

Our refund policy is governed by the following principles:

  • Government Fees: Government filing fees are non-refundable once submitted to IRCC or other authorities.
  • Professional Fees: Refunds for professional fees depend on the stage of service completion at the time of cancellation, as outlined in your Retainer Agreement.
  • Consultation Fees: Consultation fees are non-refundable once the consultation has taken place.
  • Application Refusal: Professional fees are not refundable if your application is refused by IRCC, as the service (application preparation and submission) has been completed.

Specific refund terms are detailed in your signed Retainer Agreement.

6. Confidentiality

Confidentiality Notice:

Thank you for your trust in our firm. Please note that a formal client relationship with RSTM Immigration is established only once a retainer agreement has been signed by both the client and one of our consultants. Until that time, no individual is considered or deemed to be a client. Any preliminary assessment provided free of charge or paid consultation does not constitute a Consultant-Client relationship.

We are committed to maintaining the confidentiality of your personal information in accordance with our Privacy Policy and the professional standards set by the CICC.

All communications between you and our consultants are protected by professional confidentiality obligations, except where disclosure is:

  • Required by law
  • Necessary to prevent imminent harm
  • Authorized by you in writing

7. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
  • Our total liability for any claims arising from our services shall not exceed the total fees paid to us for those services.
  • We are not responsible for delays or failures in service delivery caused by circumstances beyond our control, including government processing times, system outages, or force majeure events.

This limitation of liability does not affect any rights you may have under applicable consumer protection laws that cannot be waived or limited by contract.

8. Termination of Services

Either party may terminate the service agreement under the following circumstances:

Termination by Client:

  • You may terminate services at any time by providing written notice
  • Refunds will be calculated based on work completed as per the Retainer Agreement
  • You are responsible for any government fees already submitted

Termination by RSTM Immigration:

  • Non-payment of fees despite reasonable notice
  • Discovery of misrepresentation or fraud
  • Client's failure to cooperate or provide required documents
  • Conflict of interest or ethical concerns

9. Website Use

By using our website, you agree to:

  • Use the website only for lawful purposes
  • Not attempt to gain unauthorized access to any part of the website
  • Not use automated systems to scrape or download content
  • Not transmit any viruses, malware, or harmful code
  • Not impersonate any person or entity

The content on our website is for informational purposes only and does not constitute legal advice. Immigration laws and policies change frequently; always consult with a licensed consultant for advice specific to your situation.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of RSTM Immigration or its content suppliers and is protected by Canadian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works of our content without our prior written consent.

11. Dispute Resolution

In the event of a dispute:

  • We encourage you to first contact us directly to resolve the matter informally
  • If the dispute cannot be resolved, you may file a complaint with the College of Immigration and Citizenship Consultants (CICC)
  • These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein
  • Any legal proceedings shall be brought in the courts of Ontario

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified terms.

For existing clients under a Retainer Agreement, changes to these Terms will not affect the specific terms of your signed agreement unless otherwise agreed in writing.
